Workers’ Compensation Insurance and why it’s so important

Most handymen in Atlanta do not have this insurance. There are several reasons for this but the main one is that it is terribly expensive. Many companies will advertise or tell you that they are “licensed and insured,” and that’s probably true to a degree. They probably do in fact have a legitimate business license and they probably do have at least some insurance. But that insurance is not Workers’ Compensation. What they most likely do have is CGL, also known as “Commercial General Liability insurance. This insurance covers YOU the customer in the event you are injured as a result of a service provider’s work. It also covers anything in your home that may get broken as a result of the service provider’s work. There are some CGL policies that do cover any bodily injuries to the worker but many times the amount covered is very limited. CGL is affordable insurance and there’s no reason any company should go without it. But again, it’s not Workers’ Compensation.
So what exactly is Workers’ Compensation?
To quote Wikipedia: “It is a form of insurance providing wage replacement and medical benefits to employees injured in the course of employment in exchange for mandatory relinquishment of the employee’s right to sue his or her employer for the tort of negligence. Workers’ Compensation is designed to ensure that employees who are injured or disabled on the job are not required to cover medical bills related to their on-the-job injury, and are provided the monetary awards to cover loss of wages directly related to the accident, as well as to compensate for permanent physical impairments.”
So what does all this mean?
It means that if you choose to use a service provider at your home that does not carry Workers’ Compensation that you assume risk. Here’s an example: You decide to hire handymen in Atlanta to come fix some damaged gutters at your home. This particular handyman does not have work comp insurance. During the repair the handyman falls off the ladder and is badly injured breaking multiple bones. He is now incapacitated and unable to return to work for the foreseeable future. He now has medical bills, no income and will lose future wages as well. Despite this particular handyman’s good honest nature and good intentions, if he has severe injuries and is desperate to generate income, he may decide to sue your homeowner’s policy and even you personally.
